This Privacy Policy explains how Empirical Markets LLC (“Empirical Markets,” “we,” “us,” or “our”) collects, uses, and shares information when you use our websites, dashboards, APIs, and related services (collectively, the “Services”).
By using the Services, you agree to the collection and use of information in accordance with this Privacy Policy and our Terms of Service. If you do not agree, do not use the Services.
1. Scope
This Privacy Policy applies to information we collect about you when you:
- Use our main platform UI at empiricalmarkets.com
- Access or use our APIs at api.empiricalmarkets.com
- Visit our research site at research.empiricalmarkets.com
- Create or manage an account, subscription, or API keys
- Communicate with us by email or other channels
This Privacy Policy is US-focused and is not intended to create rights under the laws of other jurisdictions. If we expand our legal obligations, we may update this Policy accordingly.
2. Information We Collect
2.1 Information You Provide to Us
We collect information you provide directly to us when you use the Services, such as when you create an account, manage your subscription, or contact us. This may include:
- Account Information: Email address, name, and password (stored in hashed form only).
- API Credentials: API keys and related metadata associated with your account.
- Support Communications: Information you provide when you contact us for support, including your email address and the content of your message.
We do not currently offer features for uploading your own financial or trading datasets, portfolios, or files into the Services. If that changes in the future, we will update this Policy.
2.2 Payment & Billing Information
We use Stripe as our third-party payment processor. When you purchase a subscription or enter payment details, your payment information (such as credit card number, billing address, and bank information) is processed directly by Stripe. We do not store your full payment card number on our servers.
We may receive limited billing-related information from Stripe, such as the last four digits of your card, card type, expiration date, billing address, and payment status, as well as subscription changes (upgrades, downgrades, cancellations) and invoices.
2.3 Information We Collect Automatically
When you access or use the Services, we automatically collect certain technical and usage information, including:
- Log Data: IP address, timestamps of requests, HTTP method, response codes, and user-agent.
- API Usage Logs: Request timestamps, route or endpoint called, rate limit events, API key or account identifier, and subscription tier in effect at the time of the request.
- Subscription Events: History of subscription changes, such as upgrades, downgrades, cancellations, and renewals.
We use this information to operate, secure, and improve the Services, enforce rate limits and Terms of Service, and understand how the Services are being used.
2.4 Cookies & Similar Technologies
We use cookies and similar technologies primarily for functional and security purposes, such as:
- Maintaining your session when you are logged in
- Protecting against cross-site request forgery and other attacks
- Remembering limited preferences where needed
We do not currently use third-party analytics cookies (such as Google Analytics) or advertising cookies on the Services.
2.5 Information from Third Parties
We do not currently obtain personal information about you from third-party data brokers, enrichment services, or marketing partners. We may receive limited information from Stripe related to billing and fraud detection (such as Stripe Radar signals), which is handled under Stripe’s own privacy practices.
3. How We Use Your Information
We use the information we collect for the following purposes:
- To Provide and Maintain the Services: Creating and managing your account, authenticating you, issuing and managing API keys, and delivering dashboards, data, and APIs.
- To Process Payments: Managing subscriptions, invoicing, and payment-related communications via Stripe.
- To Enforce Limits and Security: Monitoring API usage, enforcing rate limits, preventing abuse, securing our infrastructure, and investigating suspicious activity.
- To Communicate with You: Sending transactional emails about your account, subscription, security alerts, and responses to your support requests.
- To Improve the Services: Analyzing aggregate usage patterns (such as most-used endpoints) to refine performance, reliability, and product features.
- To Comply with Legal Obligations: Keeping records for accounting, tax, and regulatory purposes, and responding to valid legal process.
We do not use your personal information to sell targeted advertising, and we do not sell your personal information to third parties.
4. AI, Machine Learning & Personal Data
Empirical Markets builds models that generate analytics and predictions on financial data. We design our systems so that personal information about individual users is not used to train or personalize models in a way that would create individual financial advice or profiles.
We do not use your personal information (such as your name, email, or account identity) to train personalized models unique to you, nor do we train models using your personal trading data, because we do not collect such trading data through uploads.
We may use aggregated, de-identified usage statistics (for example, counts of how often certain endpoints are called) to improve system performance and reliability. These aggregated metrics do not identify you personally.
6. Data Retention
We retain information for as long as reasonably necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements.
- Account Data. Account information (such as name, email, hashed password, and API keys) is retained while your account is active. If you deactivate or we “soft delete” an account, we may retain certain records in an archived state for legal, security, and audit purposes.
- API Usage Logs. API logs (including timestamps, endpoints, rate-limit events, and account identifiers) may be retained for an extended period to help investigate abuse, ensure security, and understand service performance.
- Billing & Subscription Records. We retain billing and subscription records for periods required by tax, accounting, and financial regulations.
Because we currently use soft deletion, some information may remain in backups or archives even after your account is no longer active. We will not use archived data for any purpose inconsistent with this Privacy Policy.
7. Your Choices & Rights
7.1 Account Information
You can access and update certain account information (such as your name and email address) by logging into your account on the Services.
7.2 Account Deletion
We are planning to offer self-service account deletion features that will allow you to deactivate your account. Even after an account is deactivated or deleted, we may retain certain information where we have a legitimate business need or legal obligation to do so, such as billing records, logs for security and fraud prevention, or data required for compliance.

7.3 Email Communications
We may send you transactional emails about your account, such as security alerts, subscription updates, or critical service announcements. Because these messages are important to your use of the Services, you may not be able to opt out of them while your account is active.
7.4 US State Privacy Laws
Various US state privacy laws may provide additional rights (such as the right to access, correct, or delete personal information). If you are a resident of a state that grants such rights, you may contact us at support@empiricalmarkets.com to submit a request.
We do not sell or share personal information as those terms are defined under certain state laws, such as the California Consumer Privacy Act (CCPA), and therefore do not offer a “Do Not Sell or Share” link at this time.
8. Security
We use reasonable administrative, technical, and physical safeguards to protect your information, including practices such as:
- Storing passwords using industry-standard hashing algorithms
- Restricting access to production systems to authorized personnel
- Logging and monitoring for unusual or abusive API activity
However, no method of transmission over the internet or method of storage is completely secure. We cannot guarantee absolute security.
9. Children’s Privacy
The Services are not directed to, and we do not knowingly collect personal information from, children under the age of 13. If we become aware that we have collected personal information from a child under 13 without appropriate consent, we will take steps to delete such information.

10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Effective” date at the top. If we make material changes, we may provide additional notice (such as by email or prominent notice on the Services).
Your continued use of the Services after any changes to this Privacy Policy will constitute your acknowledgment of the changes and your consent to the updated Policy.
